FAQ

When should I contact the Law Offices of John V. Hogan?

-If you need to determine whether you are eligible for disability benefits.

- If your claim is denied.

- If Social Security or your LTD carrier tries to schedule you for a medical examination or functional capacity exam.

What about attorney fees?
Most cases are handled on a contingent fee basis (no fee unless you win). However, some attorney feesLTD cases require a retainer and hourly fees. A full discussion of fees will take place at your consultation. However, regardless of the nature or outcome of your claim you will be responsible for reasonable and necessary out of pocket expenses (such as the cost of medical records and reports). This too will be discussed and a written fee agreement will be signed before representation begins.

lawyerDo I need a lawyer?
Many claims are granted without the need for representation. However, obtaining your disability benefits is a very important legal matter. A consultation with an experienced attorney will help determine whether you need representation at the initial application stage and help protect your legal rights.

My LTD carrier has offered to appoint a representative for my social security case at no cost to me. Should I use them?
It depends. Is the representation from out of state? Is he or she an attorney? Do they work for the LTD carrier directly or indirectly? Are they primarily concerned with the LTD carrier's interests or yours?
